Unum Faces Class Action Lawsuit Over Disability Claim Denials

Unum Faces Class Action Lawsuit Over Disability Claim Denials By John Curran
California residents who are worried about certain disability insurance benefits running out prematurely should considering consulting with a Unum insurance lawsuit attorney about a pending class action lawsuit there. At issue is a simple change in math that can have significant consequences.Plaintiff Ruben Don says in the Unum class action lawsuit that the company's contract regarding his monthly payments stipulated that a regular five percent increase should be applied to the maximum lifetime benefit, as well as a monthly benefit. That number is slightly higher than, but generally corresponds to, the drop in buying power from disability insurance payouts that comes as a result of inflation. More... Add new comment

Warnings About Zithromax Heart Effects Reach Other Countries By Courtney Coren
Health Canada made an announcement last week that they are updating the Zithromax side effects label to include the cardiovascular risks associated with the popular antibiotic. The update follows a warning by the U.S. Food and Drug Administration that Zithromax can cause fatal cardiac side effects in certain users. Both Zithromax and Zmax SR (both generically called azithromycin) warning labels will now include the risk of potential fatal heart risks for those who take the antibiotic. Yasmin & Yaz Blood Clot Injuries Lead to Lawsuits By Jessica Tyner
Yasmin/Yaz can lead to blood clots, deep vein thrombosis (DVT), pulmonary embolism and ultimately death. According to the British Medical Journal and FDA, using the popular birth control pills can lead to a 74 percent increase in blood clots and related injuries. Unfortunately, many women weren’t aware of the risks of Yasmin blood clots since the warning label on the product did reflect this statistic. The number of Yasmin blood clot victims numbers in the thousands. Many of these victims have sued Bayer for their injuries. The company has already paid out millions of dollars in Yasmin/Yaz lawsuit settlements, which has helped these victims cover their medical expenses and compensate them for their pain and suffering. However, many Yasmin sufferers simply want to help other women avoid the nightmare they endured. |

Bankrupt Bondex International Pays Up for Asbestos Exposure

Bankrupt Bondex International Pays Up for Asbestos Exposure By Amanda Antell
Bondex International Inc., the bankrupt unit of Rust-Oleum maker RPM International Inc., may owe $1.17 billion to current and future asbestos victims. U.S. Bankruptcy Judge Judith K. Fitzgerald, in Wilmington, Delaware, sided with the prosecuting lawyers who were representing the asbestos exposure plaintiffs. The defendant’s calculation method using Bondex and Specialty Products Holding Corp., which totaled that debt to only $575 million, was denied. Bondex and Specialty Products filed for bankruptcy in May 2010, with plans to set up an asbestos-victims trust to settle current and future lawsuits. To calculate how much money went into the trust, the companies and its creditors submitted detailed monetary estimates of the size the claims would be predicted to be. This way, Bondex can win immunity from future asbestos lawsuits by setting up trusts to cover any and all expenses associated with asbestos exposure. |

Utah Resident Files Propecia Lawsuit Over Persistent Side Effects By Amanda Antell
On April 10, 2013, a Utah plaintiff filed legal action against Merck & Co., adding to the growing number of Propecia (finasteride) lawsuits that have been launched against the drug maker. However, nine days later on April 29, 2013, the court ordered the case to be moved to the multidistrict litigation (MDL) proceeding in the U.S. District Court for the Eastern District of New York. The plaintiff was prescribed Propecia in 2005 when he was 38 years old. Popularly used to treat male-pattern baldness, Propecia works by interfering with the body’s balding process. At the time he was first prescribed the medication, the plaintiff was not diagnosed with cognitive impairment, depression, or sexual dysfunction. However, after using the medication, the plaintiff was diagnosed with all three complications. Even after he stopped using Propecia, the alleged side effects continued to hinder him. |

Judge: Mirena MDL Lawyers Need Female Leadership By John Curran
Women who have dealt with intrauterine device problems like organ perforation and other Mirena IUD side effects may opt for female legal representation, but at a recent status conference a team of four male practitioners petitioned to be on the executive committee expected to lead the litigation process. After a protest letter, Judge Cathy Seibel said that the gender ratios did not make sense. After all, she noted, female Mirena IUD lawsuit attorneys could better understand the trauma that any plaintiffs experienced as a result of the devices' movement as well as what it is like to talk to a gynecologist about contraception. Knowing these issues and understanding the clients' side on a personal level can help with finding expert witnesses to talk about Mirena IUD spontaneous migration side effects as well as developing testimony for the direct examinations. |
